Colorado Department of Labor Revises Colorado Affirmation Form

Under the Colorado Employment Verification Law (C.R.S. 8-2-122), all public and private employers who contract business in the state of Colorado are required to complete and retain the Colorado Affirmation Form for each employee hired on or after January 1, 2007.  The Colorado Affirmation Form must be completed by the employer within 20 calendar days of the employee’s hire.

On September 1, 2014, the Colorado Department of Labor issued a revised Colorado Affirmation Form with a revision date of September 1, 2014. The new, updated form is valid from September 1, 2014 through October 1, 2017.  Colorado employers must use the updated Colorado Affirmation Form (revision date 09/01/2014) for all employees hired after October 1, 2014.  Employers may also choose to use the updated version of the Colorado Affirmation for employees hired between September 1, 2014 and October 1, 2014.

In addition to completion of the Colorado Affirmation Form, the Colorado Employment Verification Law also requires Colorado employers to keep photocopies of the employment authorization documents presented by the employee in conjunction with completion of Federal Form I-9.

Failure to properly complete and retain the Colorado Affirmation Form and photocopies of employment authorization documents can subject employers to significant civil penalties.
